When you buy a sound or video on ASMR Market, data broker s.r.o. grants you a licence under the rights the artist has given us. This page explains what each licence allows. It forms part of the Terms of Sale.
Copyright stays with the artist
A licence gives you permission to use a work. It never transfers the copyright, which stays with the artist. All rights not expressly granted here are reserved. Licences are personal to the buyer and cannot be transferred, unless this page says otherwise.
The three licences
Each item has a base price set by the artist. Licence prices are multiples of that base price:
- Personal: 1× the base price.
- Creator: 3× the base price.
- Commercial: 10× the base price.
Creator and Commercial licences are available only where the artist offers them on the item page. The licence you bought is shown on your receipt and in your library.
Personal licence
Included with every purchase by default.
- Listen privately on your own devices, as often as you like.
- Download and keep the files forever.
- No public use: you may not play the sound in public, broadcast it or use it in any published content.
- No redistribution: you may not share, upload, sell or give away the files.
Creator licence
For individual creators who want to use a sound in their own content. Available only if the artist offers it.
- Use the sound inside your own videos, live streams and podcasts, including monetized ones.
- Credit is required in the description or show notes: "Sound by <artist> via ASMR Market".
- No reselling or redistributing the raw audio, alone or as a separate file.
- No inclusion in sound libraries, sample packs or stock collections.
- No use in advertising for third parties, such as client work or sponsored ads made for a brand.
- Includes personal listening as under the Personal licence.
Commercial licence
For brands, agencies and businesses. Available only if the artist offers it.
- Use the sound in advertising, apps, games, installations, brand campaigns and similar commercial projects.
- Granted per project, worldwide and in perpetuity. A new project needs a new licence.
- No resale of the sound as a standalone sound or file.
- No use in sound libraries, sample packs or stock collections.
- No use to train artificial intelligence.
- A licence certificate is included with your order.
Custom recordings and Circle content
- Custom recordings come with the Personal licence and are private to your account.
- Circle content can be streamed for personal listening while your membership is active. It is not a purchase: access ends when the membership ends, unless you bought the item separately.
- Free sounds come with the Personal licence.
Never allowed under any licence
- Claiming authorship of the work or presenting it as your own recording.
- Registering the sound, or content that contains it, with Content ID or any similar rights-management system.
- Using the sound to train, fine-tune or test artificial intelligence or machine learning models, or to clone the artist's voice. We also reserve these uses for text and data mining purposes.
- Using the sound in sexualised contexts of any kind.
- Using the sound in defamatory, hateful, misleading or illegal ways, or in a way that suggests the artist endorses something they do not.
How long licences last
Licences are perpetual. They survive if the artist later removes the sound from sale or closes their shop. A licence ends if the purchase is refunded or you withdraw from it, or if you seriously break these terms, in which case you must stop using the work and delete your copies.
